Colorado To Consider ‘Red Flag’ Gun Law

A second amendment argument is gearing up in Colorado and gun owners across the state are keeping an eye on it.

The legislation, HB 19-1177, would allow a family member, law enforcement or someone in the house to ask for what is known as an extreme protection order. They would have to present to the court evidence that the person in question poses a significant threat to others or themselves by having a firearm, or be able to purchase one.

This would require the individual to appear before a judge and, if it is determined the individual is a risk, that person could lose their guns for up to 364 days.

Some are seeing it as protection of the public while others see it as just another attempt to infringe on their constitutional rights.

Opponents of the bill state it violates the 2nd amendment as well as the 5th.

Lawmakers attempted to pass a similar bill in 2018.
