Corporal Cody Kennedy believed he was in imminent danger.

That's the reasoning behind the decision to not charge a Grand Junction Police Officer involved in a shooting.

The incident took place at an apartment complex on North Avenue back on October 12. 20-year-old Michael Comacho had pointed an object, believed to be a gun, at Cpl. Kennedy. He had also threatened the officer in this exchange. According to witness reports, Comacho refused on several occasions to follow Kennedy's commands to drop the weapon and show his hands. Kennedy then proceeded to shoot the suspect in the hand causing Comacho to drop the weapon.

After a few non-fatal rounds were dispersed, Comacho was finally arrested and charged with first degree assault on a peace officer and menacing.
