The law used to be any texting while driving was considered illegal. However, that has now changed. There are still fines for texting, up to $300 and as possible four points now, but if you look carefully the law states you can text while driving. As long as you don't do it in "'a careless or imprudent manner."

Lawmakers believe that the tougher penalties and higher fines will deter drivers from taking that chance. Others, however, are convinced that drivers will continue to believe they won't get caught and maintain their texting habits.

Here is a breakdown of what officers are looking for:

Officers must see a driver actually typing. No more witness statements.
In addition, the officer must witness careless driving. That, by law, is defined as without due regard for the width. grade, curves, corners, traffic, and use of the streets and highways and all other attendant circumstances.

All I know is that you don't have to worry about me texting and driving. I have tried it and failed miserably. Actually scared me. Completely forgot I was actually driving a vehicle.

Just to be on the safe side, please put the phone down until you reach your destination. It's not worth it.
